Modification of Terms
We may from time to time change the terms that govern your use of the Site and recommend you review these as often as possible. Your use of the Site following any such change constitutes your agreement to follow and be bound by the terms as changed. We accept no liability or responsibility as a result of any such changes.
Use of Site
Items purchased using the Site are for the personal or gift use of the purchaser only and are not to be used for re-sale, commercial purposes or any other commercial benefit. WorldWear expressly reserves the right to restrict multiple quantities of an item being delivered to any one customer or postal address.
Contractual Capacity
The use of the Site and purchase of items is strictly limited to customers who can lawfully enter into and form contracts.
Accuracy of Site Content
WorldWear has taken every care in the preparation of the content of the Site, in particular to ensure that prices quoted are correct at the time of publishing and all items have been fairly described. However, orders will only be accepted if there are no material errors in the description of the items or their prices as advertised on the Site.
We have made every effort to display as accurately as possible the colours of the items that appear on the Site. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the item on delivery.
To the extent permitted by applicable law, WorldWear disclaims all warranties, express or implied, as to the accuracy of the content contained in any of the materials on this Site.
Ownership of Rights
All rights and intellectual property rights, including copyright, in the Site are owned by WorldWear. Any use of the Site or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of WorldWear. The only exception to these rights is the manufacturer's rights to trademarks, slogans, logos or designs.
Submissions
Any feedback or comments between WorldWear and any customer is to be treated as a submission to WorldWear. By making any submission to WorldWear you are granting WorldWear absolute use of the material, ideas, suggestions, concepts or comments and transferring ownership of any rights in the submission to WorldWear. WorldWear is therefore not required to name the customer, compensate the customer or reward the customer in any way, unless required by law.
Communication
You agree that WorldWear may send emails to you for the purpose of advising you of changes or additions to the Site, about any items or services, or for such other purpose(s) as WorldWear deems appropriate.
Limitation of Liability
To the extent permitted by New Zealand law, WorldWear shall not be liable to any customer in any way for any damages arising from the use of the Site. This limitation of liability applies to damages of any kind, including direct, indirect and incidental, loss of income, profit, data, property and claims by third parties.
To the extent permitted by applicable law, WorldWear disclaims all warranties, express or implied, as to the condition of the items displayed on the Site.
WorldWear will endeavour to ensure the Site will be uninterrupted, timely, secure and free of errors, however we do not accept any liability towards any customer for failure to achieve this. We reserve the right to correct any errors and to change or update information at any time without prior notice (including after you have submitted your order).
Indemnification
You agree to defend, indemnify and hold WorldWear harmless from and against any and all claims, damages, costs and expenses, including legal fees, arising from or related to your use of the Site.
Governing Law
This Site, any content contained herein and any Agreement brought into being as a result of usage of the Site are governed by and construed in accordance with New Zealand Law.
